Grounds Training – www.groundstraining.com – is a trading subsidiary of Pitchcare – www.pitchcare.com – and as such you are bound by the general terms of use relating to the website – https://www.pitchcare.com/pitchcare/disclaimer.php. Please read these terms of use carefully before you start to use the site. By using Our Site, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, please refrain from using Our Site.

Online Courses

After booking onto an Online Course you will be given access to the Moodle training platform on the terms of the licence referred to below for a period of 90 days.
All training materials are owned by Maxwell Amenity Limited. All intellectual property rights in all materials, including the design, graphics and text of all printed materials and videos are owned by Maxwell Amenity Limited.

Licence:

When you are given access to the Moodle training platform, you are granted a non-exclusive, non-transferable, revocable licence to use the Grounds Training materials. No content may be copied, reproduced, uploaded, posted, displayed or linked to in any way, in whole or in part, without prior permission and you may not allow anyone else to access the training platform via your log-in details. Any such use is strictly prohibited and will constitute an infringement of Maxwell Amenity Limited’s intellectual property rights.

Provision of Service:

Maxwell Amenity Limited warrants that it has the right to provide the Online Course service and will use all reasonable skill and care in making this service available to you and in ensuring its availability. Because of the nature of the internet, errors and omissions do occur and Maxwell Amenity Limited does not give any other warranties in respect of the Online Course service.

Maxwell Amenity is continually seeking to improve the Online Course service and reserve the right, at its discretion, to make changes to any part of any this service provided that it does not materially reduce its content or functionality.

Purchase and Delivery:

The prices for the relevant Online Courses are on our website. By clicking on the “purchase” button, you agree to these terms which will bind you and (if you are an employer) your employees. If you do not agree to these terms, we shall not sell training materials or documentation to you and you must discontinue the purchasing process.

Once your registration for an Online Course has been successfully processed, and payment received, you will be sent an email confirming your purchase with details of how to access the Moodle Training platform. The relevant Course Manual will be sent out to you immediately by first class post.

If your purchase includes a day’s Practical Training, we will endeavour to provide this training within reasonable travelling distance and within 120 days of the purchase.

For clarification – your participation in any Online or Practical Course does not replace or equate to any Lantra Awards Certificate of Training or NPTC Certificate of Competence relevant to the machines and/or equipment used on the course.

Cancellation and Refunds:

Once you have booked an Online Course, the fee is non-refundable and the booking non-transferrable. If you cancel any Online Course, you will not be entitled to any refund, nor will you be able to transfer your booking either to another person or onto another Online Course.

Your access to the Online Course service may be terminated by written notice if you are in material breach of these terms. If we reasonably believe your breach of these terms affects our lawful operation of the Online Course service or third party customers we may suspend your access to the service at any time.

Payment and Refund Policy for Training Courses (excluding Online Courses), including Cancellation and Substitutions

Maxwell Amenity Limited accepts course bookings through the Pitchcare.com web site, payment being made online by credit card. For some clients, eg local authorities and schools, we will invoice and payment may be made by BACS or cheque. In making such bookings clients accept this refunds, cancellations and substitutions policy.

For credit card payments, the course fees are payable in full at the time of booking. Places on courses arranged by Maxwell Amenity Limited are strictly limited. Upon receipt of your order and payment your place will be confirmed.

For payments on invoice, we require 50% of the booking fee to be paid immediately, with the balance being paid no later than one week before the start of the course.

Cancellation charges are applied in all cases. We regret that we have to do this, however all bookings involve administrative costs and it is difficult to fill spaces made vacant by late cancellations.

Cancellation charges depend on when the written cancellation notice is received. A full refund will be given only if more than 4 weeks’ notice is given of a cancellation, see below for refund rates:

  • Over 4 weeks’ cancellation notice: Full refund
  • 2-4 weeks cancellation notice: 50% refund
  • Less than 14 days cancellation notice: No refund unless in exceptional circumstances, for which a medical certificate may be requested.

Alternatively, a substitute delegate can be named up to two weeks before the course date after which, a charge will be made for re-registration.

No refund will be payable for non-attendance or if no prior notice of cancellation is given.

The refund will be issued after the course.

In the event of a candidate failing an assessment, it is the responsibility of the candidate to arrange the date and payment for the reassessment direct with the assessment body.

It may be necessary for reasons beyond the control of Maxwell Amenity Limited to change the content and timing of the course, the date, venue or instructor. Pitchcare.com Limited. We reserve the right to cancel a course up to and including the date of the course if insufficient bookings have been received. We will strive to give as much notice as possible in such an event. In all cases, people who had registered to attend a cancelled course will be given the option of a full refund or of rescheduling to a future course date but Maxwell Amenity Limited disclaim any further liability.
